Trademark Usage Guidelines

These Trademark Usage Guidelines are for LiveTube Ltd.’s licensees, authorized resellers, developers, customers, and other parties who wish to use LiveTube’s trademarks, names, and logos (“LiveTube Trademarks”) for their own purposes, including in promotional, advertising, instructional, or reference materials, or in or on web sites, products, labels, or packaging. Note that any use of LiveTube logos and/or use of any LiveTube Trademarks outside of these guidelines requires permission and without such permission may constitute trademark infringement under federal and state laws.

 

LiveTube Trademarks

LiveTube Trademarks are valuable assets LiveTube needs to protect. We ask that you help us by properly using and crediting LiveTube Trademarks in accordance with these guidelines. The LiveTube Trademarks specifically include:

  • LiveTube
  • LT
  • LiveTube – Closer Than Live

Permissible Uses

You may generally use the LiveTube, LT and LiveTube – Closer Than Live trademarks to refer to the associated LiveTube products or services. For instance, an authorized broadcaster may note in its programs, advertisements and products that it utilizes the LiveTube content. Similarly, such a broadcaster may issue a press release stating that it is using content from LiveTube.

Correct Use

Proper use of LiveTube’s Trademarks reinforces their role as brands for our products and services, and helps prevent them from becoming generic names that can be used by anyone. Examples of former trademarks that became generic terms are “aspirin,” “cellophane,” and “escalator.” By adhering to the following rules, you help protect LiveTube’s investment in its trademarks.

Use a Generic Term

Use a generic term in association with each LiveTube trademark the first time the mark appears in text, and as often as possible after that. You need not include generic names in headlines, package titles and documentation titles. “LiveTube producer” is an example of generic term use.

 

Do Not Vary the Trademarks

Do not vary LiveTube Trademarks by changing their spelling or abbreviating them. For example, “LiveTube” not “Live Tube”, “LiveTube – Closer Than Live” not just “Closer Than Live” or the like.

Do not use any name or trademark confusingly similar to the LiveTube Trademarks or any other trademark or trade name owned by LiveTube for which LiveTube has not given you permission. And do not use the LiveTube Trademarks in such proximity to any of your own trademarks or trade names or third party trademarks so as to create a combination or composite mark.

 

 

“LiveTube” As a Trade Name

Trade names are the actual business names of companies. Trademarks and trade names are not the same, even though many companies use their trade names as trademarks. If you are using “LiveTube” as a substitute for LiveTube Ltd., you are using it as a trade name. Because they are nouns, trade names can be used in the possessive and do not require a generic term or a trademark symbol. Thus, you should not use a ® after “LiveTube” when it appears as part of the full corporate name or as a trade name.

Examples:

  • Corporate Name: This video was produced by LiveTube Ltd.
  • Trade Name: This video was produced by LiveTube.
  • Trade Name: LiveTube’s breaking news are unique.
  • Trademark: LiveTube® – the first place for curated live video and breaking news.

 

Trademark Symbols And Credit Lines

Trademark Symbols

Proper trademark attribution through trademark symbols and credit lines helps make others aware of our rights, and helps prevent them from becoming generic terms. Credit lines also help clarify that they belong to LiveTube. Accordingly, you should attribute ownership of LiveTube Trademarks to LiveTube Ltd. by using a trademark symbol (®) and credit lines as detailed below.

Use the ® symbol with the most prominent appearance of the “LiveTube” mark on products, packaging, manuals, advertisements, promotional materials and Web pages (for example, in the headline of an advertisement), and the first use of the mark in text or body copy. This includes situations where “LiveTube” is a part of a product or service name (for example, LiveTube® producer platform). An example would be

The producers curate all incoming live video on the LiveTube® Producer Hub. XYZ Broadcaster has taken the breaking news video from the LiveTube® licensing platform. This clip is one of numerous videos they have created using LiveTube material.

“LiveTube” receives a trademark symbol in the headline because this is the most prominent appearance, and when it appears as part of the “LiveTube platform” name because this is the first appearance in text. While there is no trademark symbol after “LiveTube” when it appears in front of the term “video” since this is not the first time that the term “LiveTube” appeared in body copy. That said, it is always acceptable to continue using the ® after “LiveTube” throughout the document.

 

Credit Line

All products, packaging, manuals, advertisements, promotional materials and web pages bearing LiveTube Trademarks should include the following trademark credit line.

“LiveTube and LT are registered trademarks of LiveTube and/or its affiliates. Other names may be trademarks of their respective owners.”

The credit line may appear anywhere on the collateral, but typically is displayed on a copyright page, the back of a package or at the end of a document or web page.

 

Prohibited Uses

You may not use any of the LiveTube Trademarks

  • in a manner that could cause confusion as to LiveTube sponsorship, affiliation or endorsement; or
  • in a manner that shows LiveTube or its products in a false or derogatory light

Take particular care not to use LiveTube Trademarks as set out below.

 

Company, Product or Service Names

Do not use LiveTube Trademarks or potentially confusing variations as all or part of your company, product or service names.

 

Corporate Logo Use

The LiveTube corporate logo is the most recognizable expression of LiveTube’s brand. We ask that you help us protect this important asset.

We understand and appreciate that LiveTube licensees, authorized publishers, producers, reporters, customers, as well as outside parties, may want to show affiliation with LiveTube. However, use of the LiveTube corporate logo to imply affiliation with or endorsement by LiveTube without express written permission by LiveTube is strictly prohibited. Affiliation with LiveTube or LiveTube programs does not imply the right to use the LiveTube corporate logo.

Request Permission

Please contact the LiveTube Legal Department using the contact information below. You will be asked a few questions to help us determine your intended use of the material and your relationship to LiveTube. We will respond to you based on our policy and may ask you to provide additional information in order to review your request.

 

Trade Dress

You may not imitate LiveTube trade dress, type style or logos. For instance, do not copy LiveTube’s layout or styling of its web pages for use with your product, or display your product name in the distinctive logotype associated with the LiveTube logo.

 

Domain Names

Do not use LiveTube Trademarks or potentially confusing variations in your Internet domain name. This helps prevent Internet users from being confused as to whether you or LiveTube is the source of the web site.

 

Merchandise Items

You may not manufacture, sell or give-away merchandise items, such as T-shirts and mugs, bearing any of the LiveTube Trademarks or any other LiveTube marks or names, including symbols, logos, or icons, except pursuant to an express written trademark license from LiveTube.

 

Report Usage Violations

Please report suspected misuse of logos, trademarks or copyrighted material to trademark@livetube.tv

 

Ownership

Nothing in these guidelines gives you any right, title or interest in the LiveTube Trademarks, or any other trademark or trade name of LiveTube, except the right to use the trademarks solely to identify your actual use of LiveTube content and services. You agree that the LiveTube Trademarks, and all intellectual property rights therein, are solely owned by LiveTube, and that any and all uses Trademarks, and all goodwill derived therefrom, whether or not done pursuant to the written Agreement, shall inure solely to the benefit of LiveTube.
