5.4 Right to Erasure
Users have the right to request the deletion of their personal data at any time. For more information on how to exercise this right, please refer to our Right of Erasure page.
6. Content on the Services
6.1 User Responsibility
You are responsible for your use of the Services and for any Content you provide, including compliance with applicable laws, rules, and regulations. You should only provide Content that you are comfortable sharing with others.
6.2 Content Risks
While LiveTube strives to validate and verify the accuracy and reliability of Content shared via the Services, any use or reliance on any Content or materials posted via the Services or obtained by you through the Services is at your own risk. We do not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Services.
6.3 Role of AI and Automated Systems
LiveTube uses AI and automated systems to validate and verify content submitted through our Services. These systems can make final decisions on whether content meets our quality standards and guidelines. The use of AI helps ensure timely, accurate, and consistent moderation of content. Users are notified when content is under review by AI, and they will be informed of the outcome, whether their content is accepted for broadcast or declined based on the AI’s assessment.
6.4 Exposure to Content
By using the Services, you may be exposed to Content that might be offensive, harmful, inaccurate, or otherwise inappropriate. All Content is the sole responsibility of the person who originated such Content.
6.5 Intellectual Property Rights
LiveTube respects intellectual property rights in compliance with global standards. For more information, see the World Intellectual Property Organization (WIPO) for details on international IP laws and protections. LiveTube expects users of the Services to do the same. We reserve the right to remove Content alleged to be infringing without prior notice, at our sole discretion, and without liability to you. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us, as described in our separate Copyright policy. If you believe that your Content has been copied in a way that constitutes copyright infringement, please report this by writing to us at copyright@livetube.tv.
6.6 Authorized Use of LiveTube Content
LiveTube content is intended for use by LiveTube and other explicitly authorized parties. Only parties that have signed a contract with LiveTube and are in a direct contractual relationship with us are authorized to use, distribute, publish, or otherwise utilize LiveTube content. Unauthorized use, distribution, publishing, or any other form of utilization of LiveTube content without a written agreement or explicit permission is strictly prohibited. LiveTube reserves the right to share its content across various platforms, including but not limited to Facebook, X, Instagram, TikTok, YouTube, and the LiveTube Newsroom. LiveTube allows the sharing and embedding of its content via framing technology, provided that the content is clearly attributed to LiveTube, including direct links back to the original content on LiveTube or the relevant platform, and that the content is not altered.
6.7 Your Rights
By submitting, posting, or displaying Content on or through the Services, you grant us a worldwide, exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such Content in any and all media or distribution methods (now known or later developed). This license authorizes us to make your Content available to the rest of the world. You agree that this license includes the right for LiveTube to provide, promote, and improve the Services and to make Content submitted to or through the Services available to other companies, organizations, or individuals for the syndication, broadcast, distribution, promotion, or publication of such Content on other media and services, subject to our terms and conditions for such Content use. Such additional uses by LiveTube or other companies, organizations, or individuals may be made with no compensation paid to you with respect to the Content that you submit, post, transmit, or otherwise make available through the Services. LiveTube has an evolving set of rules for how ecosystem partners can interact with your Content on the Services. These rules exist to enable an open ecosystem with your rights in mind. You understand that we may modify or adapt your Content as it is distributed, syndicated, published, or broadcast by us and our partners and/or make changes to your Content to adapt the Content to different media. You represent and warrant that you have all the rights, power, and authority necessary to grant the rights granted herein to any Content that you submit.
6.8 Media Professionals and MediaHub Access
Access to the LiveTube MediaHub is restricted to broadcaster and publishing professionals. Usage is guided by the LiveTube Media License. Media professionals wishing to use LiveTube content must adhere to the terms outlined in the Media License, which governs how the Content may be used, modified, and distributed. By accessing the MediaHub, you agree to comply with all provisions of the Media License.
7. Payment and Streaming Terms
7.1 Payment Commencement
Payments for streaming begin only when a LiveTube stream has been selected for broadcast by a newsroom producer. No payments are made for streams that have not been chosen, whether declined by automated systems, AI, or a newsroom producer. Additionally, no payments are made for the time users spend waiting for their stream to be approved or “green-lighted” for broadcast.
7.2 Stream Status Indicators
When users initiate a stream, it enters the “Connecting” or “Looking for a Producer” phase. During this time, the stream is validated and verified by automated systems or AI for content quality and adherence to LiveTube’s guidelines. No payments are made during this phase, and streams can be declined without human review.
- Connected: When the status changes to “Connected,” the stream has been linked to the LiveTube Newsroom for review by a live producer. Payment still does not begin at this stage. The live producer reviews the stream for its relevance, quality, and compliance. Users see this status as an indicator that their stream is under active review, but payment is not yet initiated.
- Live Broadcast – Payment Activation: If the newsroom producer decides to broadcast the stream, the status changes to indicate the stream is live. Users will see a red border around their screen, a flashing “LIVE” icon, the elapsed time, and a real-time earnings counter that updates every minute. This indicates that the stream has been selected for broadcast and payment has started. The amount displayed includes both the base rate and the accumulating per-minute rate, showing users exactly how much they are earning as they stream.
- Declined Streams: LiveTube does not pay for any streams that are declined, whether by automated systems or AI during validation or by newsroom producers after review. Users will not receive any compensation for streams that are not broadcast.
7.3 Stream Termination and Fair Payment Policy
Only newsroom producers have the authority to end a live stream, ensuring the content is valuable and meets LiveTube’s standards. Users are generally not allowed to terminate their streams independently. LiveTube aims to ensure fairness and value. To prevent misuse, LiveTube may deny or adjust payouts if a user ends a stream shortly after starting it solely to collect the initial payment without providing meaningful content. Users are not required to unnecessarily stream for extended periods. If users must stop a stream for valid reasons, such as safety concerns or unavoidable technical issues, they should notify the newsroom producer. LiveTube will take these circumstances into account and address them appropriately.
7.4 Fraud, Misconduct, and Discretionary Payments
LiveTube reserves the right to withhold or refuse payments in cases of detected fraud, manipulation, or violations of LiveTube Rules. Payments may be adjusted at the newsroom producer’s discretion based on the story’s impact, quality, and relevance. For instance, if it is determined during a LiveTube broadcast that the content is of global breaking news, a major event, or highly relevant, the producer may decide to increase the payment amount. The producer will notify the user of such adjustments after the stream.
7.5 Offers and Location-Based Payments
Users might receive offers via email, in-app messages, or app notifications about specific payments for streams on particular topics or events happening near their location. Users may also be asked to move to locations near newsworthy events. In these cases, the price mentioned in the offer communication is the amount that will be paid.
7.6 Alternative Payment Methods
Users who do not have a PayPal account must inform LiveTube. The newsroom producer and user will discuss alternative payment methods post-stream. Payment options will be determined on a case-by-case basis, considering the user’s preferences and availability of payment processors.
7.7 Unclaimed Payments and Support
If payments are not retrieved from PayPal, the funds will be reversed to LiveTube. Users must contact LiveTube to resolve unclaimed payments. In the event of verifiable technical issues on either the user’s side or LiveTube’s side, a reattempt to process the payment may be made.
7.8 User Responsibilities
Users are responsible for providing accurate payment information and complying with all LiveTube rules and guidelines. Users must not engage in actions aimed at manipulating payment calculations, such as ending broadcasts prematurely without valid reasons. Users are solely responsible for understanding and managing any fees or taxes resulting from their payments. LiveTube advises users to consult local tax regulations and handle obligations accordingly.
7.9 Verification and Final Payment Confirmation
All payments are subject to verification by senior producers to ensure compliance with LiveTube’s rules. This verification typically occurs within 24 hours. Due to verification outcomes, final payment amounts may vary from initial estimates. Once verified, payments will be processed, and users will be notified via PayPal. All payments are considered final once processed. No further adjustments will be made except in cases of proven technical errors or discrepancies acknowledged by LiveTube.
7.10 Age Restrictions and Guardian Payments
LiveTube’s services do not target children. As outlined in our Terms of Service, only users aged 13 and older may use our platform. Users under 18 may not have a bank or PayPal account or might not be legally authorized to receive payments. In such cases, a guardian will receive the payment on behalf of the young LiveTuber. If it is discovered after a stream that the user was a child, LiveTube will not pay out any money.
7.11 Limitation of Liability for Payment Issues
LiveTube cannot be held responsible for any payment issues or delays caused by circumstances beyond LiveTube’s control. This includes but is not limited to technical problems, disruptions with payment processors, communication systems, payment facilitators, or other third-party services. While LiveTube strives to ensure timely and accurate payment processing, users acknowledge that external factors may impact the delivery of payments, and LiveTube disclaims any liability arising from such circumstances. LiveTube complies with consumer protection guidelines where applicable. For general information, please see the Federal Trade Commission (FTC) Consumer Protection guidelines.
8. Using the Services
Please review the LiveTube Rules, which are part of the User Agreement and outline what is prohibited on the Services. You may use the Services only in compliance with these Terms and all applicable laws, rules, and regulations. Our Services evolve constantly. As such, the Services may change occasionally at our discretion. We may stop (permanently or temporarily) providing the Services or any features within the Services to you or users generally. We also retain the right to create limits on use and storage at our sole discretion at any time.
We may also remove or refuse to distribute any Content on the Services, suspend or terminate users, and reclaim usernames without liability to you. In consideration of LiveTube granting you access to and use of the Services, you agree that LiveTube and its third-party providers and partners may place advertising on the Services or in connection with the display of Content or information from the Services, whether submitted by you or others.
9. Voucher and Coupon Code Usage
9.1 Usage
Voucher and coupon codes provided by LiveTube are intended for single use only, either during sign-up or as explicitly stated, and are designed to benefit both the user and the affiliate partner, where applicable.
9.2 Eligibility for Higher Payouts
Users who sign up using an affiliate link or code, or utilize promotional codes, may be eligible for higher payouts. However, payouts depend on our producers selecting the user’s livestream for broadcast, adhering to LiveTube’s discretion and professional standards.
9.3 No Guarantee of Broadcast or Payout
Using a voucher or coupon code does not guarantee the broadcast of livestreams or entitlement to payouts. Decisions to broadcast are at the sole discretion of LiveTube.
9.4 Non-Monetary Value
Vouchers and coupons carry no monetary value and are not redeemable for cash, credit, or other forms of payment.
9.5 Fraudulent Use and Consequences
Fraudulent use of vouchers or coupons will not be honored. LiveTube reserves the right to reclaim any fraudulently obtained payouts and demand repayment.
9.6 One-Time Use and Restrictions
Vouchers or coupons are for single use unless stated otherwise and cannot be combined with other offers unless specified.
9.7 Program Modification and Termination
LiveTube reserves the right to modify, limit, or discontinue the voucher program at its discretion.
9.8 Limitation of Liability for Technical Issues
LiveTube is not responsible for issues in code redemption due to technical problems outside of our control.
9.9 Discretionary Refusal and Auditing
LiveTube may refuse payouts in case of errors or misuse and reserves the right to audit and monitor voucher redemptions.
9.10 Cap on Rewards
A cap may be applied to the rewards or benefits obtainable through vouchers within a specified period.
9.11 Affiliate Responsibilities
Affiliates must adhere to specified obligations and responsibilities in the voucher program.
9.12 Prohibition of Code Harvesting and Automated Use
Harvesting codes through automated means or using bots for redemption is strictly prohibited.
9.13 User Indemnification
Users agree to indemnify LiveTube against losses due to their fraudulent or improper use of vouchers.
9.14 Account Revision
LiveTube may review and adjust user accounts if misuse of vouchers is detected.
9.15 Legal Recourse and Penalties
Legal actions may be taken against those involved in fraudulent or unauthorized use of vouchers.
9.16 Notification of Authorities
LiveTube may notify authorities in cases of suspected fraudulent activities.
By using a voucher or coupon code, users acknowledge and agree to these terms, forming an integral part of the LiveTube Terms of Service.
10. App Users and Contributors
The following terms apply to all App Users who submit live video or other media content through the LiveTube platform, referred to as “Contributors.”
10.1 Independent Contributor Responsibilities
Independent Status: Contributors are independent contractors, not employees, agents, or representatives of LiveTube. Contributors have full control over when and where they choose to report, and LiveTube does not direct them to specific locations or events. Contributors do not receive employment benefits, such as insurance, paid leave, or tax withholding from LiveTube.
Tax Obligations: Contributors are solely responsible for determining and fulfilling their own tax, social security, and other legal obligations. LiveTube does not withhold taxes on behalf of Contributors; they must comply with local tax regulations and handle any related obligations as independent contractors.
10.2 Special Assignments Disclaimer
LiveTube may provide Contributors with optional assignments, offering opportunities to cover specific events, topics, or breaking news stories. However, these assignments are solely at the discretion of the Contributor and are not requirements or obligations. Acceptance or refusal of these assignments does not impact a Contributor’s standing on the platform, nor does LiveTube assume responsibility for Contributor actions based on these assignments.
Clarification of Offers: Optional assignments from LiveTube are offers only and do not constitute employment or directed work. Contributors remain fully responsible for their safety and decisions in covering events and may choose not to participate without penalty or impact on future offers.
10.3 Assumption of Risk and Duty of Care
Assumption of Risk: By engaging in live reporting or contributing content through the LiveTube platform, Contributors acknowledge that live reporting may involve inherent risks, including but not limited to injury, harm, or exposure to hazardous situations. Contributors voluntarily assume full responsibility for these risks and agree that LiveTube does not control or assume responsibility for their safety when they choose to report in potentially dangerous environments.
Duty of Care Disclaimer: LiveTube provides general safety guidelines and real-time producer support to promote responsible reporting practices. However, this support does not imply control, nor does it guarantee safety. Contributors remain solely responsible for their own safety decisions, and LiveTube disclaims any liability for incidents, injuries, or damages that may occur during reporting activities.
Online Safety Resources: For online safety best practices, visit the National Cyber Security Centre (NCSC). Content creators may also refer to the Reporters Committee for Freedom of the Press for journalism-specific safety guidelines. LiveTube encourages all Contributors to prioritize their personal safety and utilize these resources, especially when reporting in sensitive or high-risk areas.
10.4 Legal Compliance for Content Gathering and Reporting
Contributors are fully responsible for understanding and complying with applicable laws and regulations in the jurisdictions where they report. This includes obtaining any necessary permits, permissions, or authorizations required for filming or broadcasting in specific locations. Contributors must also adhere to local laws and standards, including privacy, intellectual property, and reporting restrictions as they gather content.
LiveTube’s Limited Liability: LiveTube is not responsible for any legal infractions committed by Contributors. By using the LiveTube platform, Contributors agree to indemnify and hold LiveTube harmless against any claims, fines, or penalties resulting from violations of laws, regulations, or legal standards during reporting.
11. Content Ownership and Licensing
11.1 Transfer and Exclusive Licensing of Content
By submitting content, Contributors grant LiveTube an irrevocable, worldwide, exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such Content in any and all media or distribution methods (now known or later developed). This license authorizes LiveTube to make Contributor Content available worldwide for various uses, including but not limited to syndication, broadcast, distribution, and promotion.
Exclusive Rights: This exclusive license means that once content is submitted to LiveTube, Contributors relinquish the right to control its use or distribution. LiveTube has full authority to adapt or modify Contributor content to meet different media standards or formats.
11.2 Contributor’s Waiver of Rights
Contributors agree that once content is submitted to LiveTube, they waive any rights to modify, access, or control their content post-submission. This includes waiving any moral rights or claims over how LiveTube chooses to distribute or use the content.
No Compensation for Additional Uses: Contributors will not receive further compensation for additional uses of their content, even if it is syndicated, distributed, or published by LiveTube on other platforms or services. LiveTube’s right to distribute or use Contributor content may extend to partner organizations, subject to the original license.
11.3 Media License and Third-Party Usage
Rights to access and use LiveTube content, including content submitted by Contributors, are strictly limited to parties with whom LiveTube has established a direct contractual relationship under the LiveTube Media License. This license governs how media professionals, broadcasters, press entities, and any contracted third parties may use, modify, and distribute LiveTube content. Unauthorized use, distribution, or modification of LiveTube content without a signed agreement or explicit permission from LiveTube is prohibited.
Framing and Attribution Requirements: LiveTube allows content to be shared or embedded using framing technology, provided that the content is clearly attributed to LiveTube and includes direct links back to the original content on LiveTube or the relevant platform. Content must not be altered in any way that misrepresents the original material.
